Defending Discrimination Claims in an Employment Tribunal

Who Should Attend
This one day seminar is aimed at members of SMTs and HR practitioners in further education institutions.


Overview
Discrimination risks arise throughout an employment relationship, beginning before an individual has been recruited and continuing after the relationship has ended. Understanding and managing equality obligations to staff and the associated risks is key. The Equality Act not only harmonises existing discrimination legislation but also brings with it increased protection from discrimination and a range of new employment measures and concepts with which institutions must get to grips.  Our team of HR experts will explain the practical implications of the measures in the Act that will apply to further education institutions. Delegates will also have the chance to work through the stages of the Tribunal process.

Issues for discussion will include:

* extending the scope of disability discrimination
* transgender – explicit protection against indirect discrimination for the first time
* the extension of third party harassment to all protected grounds
* the Single Equality Duty – ‘a powerful new tool’ EHRC
* pre-employment health questionnaires – what can and can’t be asked
* the timetable for commencement of the Act (some of the provisions did not come into force in October)
* Equality Impact Assessments
* recent case law developments including the practical lessons arising from the recent leading disability case of Aylott

This event will also cover: defending allegations of discrimination in Tribunal, responding to a claim, the rules of evidence/burden of proof, vicarious liability for the acts of employees and preparing for and attending the Tribunal.

Speakers
Simon Graham, Senior HR Consultant, Protocol National

Simon is the sector’s leading expert on HR issues affecting colleges. He has operated as senior adviser to a number of Principals through recent mergers and acquisitions. Simon has experience as a college HR Director, as Deputy Director at the AoC and as Director of his own successful consultancy company serving the college sector.

Ben Wood, Senior Associate, Eversheds
Working with Corporation Members, Clerks and SMTs Ben specialises in providing employment law advice to clients in the FE sector. Recent experience includes advising colleges on mergers, TUPE, structural change, governance and diversity.
Ben conducts his own advocacy in employment tribunals and is a regular speaker at training seminars for the sector.
