The Agency Workers Regulations 2010

On October 1st 2011, the Agency Workers Regulations (AWR) came into force in the UK. The regulations derive from European legislation and are designed to give temporary agency workers parity in pay and employment conditions as they would have been entitled to had they been recruited directly by the hirer to undertake the same role. This will impact on businesses that use agency workers and will entitle such workers to the same treatment and pay as their directly employed equivalent after a qualifying period of 12 weeks.

From Day 1 Agency Workers are entitled to access to facilities and access to information on vacancies

After the 12 week qualifying period Agency Workers are entitled to the same basic working and employment conditions as if they had been recruited directly to do the job by the hirer.

The Agency Workers Regulations will not change the employment status of agency workers.

"Pay" excludes:

  • Occupational Sick pay
  • Pensions
  • Financial participation schemes
  • Bonuses related to company performance
  • Occupational Maternity/Paternity/Adoption pay.
